ALQADA Court offers to any enterprise, group of enterprises, or project stakeholder the permanent appointment of a dispute board, operating under the name CONSILIUM.
CONSILIUM is a panel of one or three neutrals appointed by ALQADA Court at the outset of a contract or project. The board meets regularly, monitors the contractual relationship, identifies tensions as they arise, and intervenes before disputes escalate into formal proceedings.
At the commencement of a contract or project, the parties jointly retain ALQADA Court to constitute a CONSILIUM board. The board is composed of one or three neutrals selected by ALQADA Court from its panel, according to the nature and complexity of the project.
The board meets at regular intervals agreed upon by the parties — monthly, quarterly, or at key project milestones. It receives reports, visits sites where necessary, hears the parties informally, and issues recommendations.
Should a dispute arise, the board is already familiar with the project, the parties, and the contractual framework. It may issue a recommendation or a binding decision, as the parties shall have agreed at the outset.
Regular meetings Scheduled sessions at agreed intervals throughout the life of the contract or project.
Site visits Where the nature of the project requires it, members of the board visit the relevant sites and installations.
Informal recommendations Non-binding guidance issued by the board to assist the parties in resolving tensions before they become disputes.
Binding decisions Where the parties have so agreed, the board may issue decisions that are immediately binding pending final resolution by arbitration.
Final report At the conclusion of the contract or project, the board issues a final report summarising its interventions and the matters resolved.
CONSILIUM is available for any long-term contractual relationship or project, including but not limited to construction and infrastructure, joint ventures and partnerships, international distribution agreements, public-private partnerships, and energy and natural resources projects.
CONSILIUM operates on a retainer basis. Fees are agreed upon at the outset and cover the board's regular meetings, availability, and administrative support provided by ALQADA Court. Additional fees apply in the event of a formal dispute resolution procedure.
